Access Agreement (RPAPL 881)

In New York, an agreement or court-granted license that lets an owner enter a neighbor's property to make improvements or repairs. Insurance requirements are often part of it.

What it means for your firm

Real Property Actions and Proceedings Law Section 881 lets an owner ask a court for a license to enter when the neighbor refuses permission. Many access arrangements are negotiated instead.

Neighbors often send one insurance list to everyone entering the property, including engineers doing surveys. Your agent can explain what your policy provides in writing.
