This Is What Reading the Fine Print Looks Like.
Four clauses from the kind of owner contract we review every week, and the notes we would send back. Most firms sign these as written.
Consultant shall defend, indemnify and hold harmless Owner from any and all claims arising out of or related to the Services.
Owner shall be named as additional insured on all policies required herein.
Professional liability of $2,000,000 per claim, maintained for five years after final completion.
Consultant waives all rights of subrogation against Owner under all required insurance.
A duty to defend, for any claim at all, is usually broader than professional liability will pay for. We suggest reimbursing reasonable defense costs to the extent caused by your negligence.
Professional liability policies generally do not add additional insureds. We tell the owner’s contract manager that up front, so it does not hold up the job at signing.
Check the limit against what you carry now, and price it before you sign. Claims made coverage only answers while a policy is in force, so five years means five renewals.
This usually needs an endorsement on general liability and workers comp. Some carriers charge for it, and a few cannot add it at all.
Have a contract to sign? The contract check shows what its insurance section asks for.
Check a contractGeneral information, not legal advice. Your attorney decides contract language; we tell you how it meets your insurance.
Five Moments Where Insurance Usually Lets Firms Down.
- 01The application
UsuallyA generic form and a generic class code. You get priced like every other office.
With usWe describe your firm the way you actually practice, so underwriters rate your real work.
- 02A contract shows up
UsuallyIt sits in your inbox while you guess whether your coverage lines up.
With usSend it over. We read the insurance section and tell you plainly what lines up and what does not.
- 03A client needs a certificate
UsuallyYou wait days, and the project waits with you.
With usCertificates go out from a team that already knows your file and your contracts.
- 04Your work changes
UsuallyA new service, a new state or a big hire goes unmentioned until a claim.
With usTell us once. We check whether the policy still describes what you do.
- 05Renewal
UsuallyThe same policy gets reissued without a second look.
With usWe review what changed and compare your options before you renew.
Most of the firms we work with are run by people who wear every hat. They design, they manage clients, they hire and they send the invoices. Insurance ends up last on the list.
Much of the market treats those firms as small accounts. Calls come back slowly, renewals get reissued without a second look and the policy describes a generic office, not the work the firm actually does. The first time anyone reads it closely is after a claim.
I started Hardcover to do the reading first. Knowing what your firm actually does, catching what a contract asks for before you sign it and being reachable when a client needs a certificate today.
Your work shapes buildings, sites and cities. Your insurance should get the same care.
