Tender of Defense

A formal request asking another party, or its insurer, to defend and pay for a claim against you, usually based on a contract or additional insured status.

What it means for your firm

General contractors and design-build firms often tender claims to the subcontractors whose work is involved, and to those subcontractors' insurers when they are named as additional insured.

Your insurer or attorney usually prepares the tender. Gather the contract, certificates and endorsements first.
