Chapter 558 Notice (Florida)

A written notice of claim Florida requires before most construction defect lawsuits. It can be served on contractors, subcontractors, suppliers and design professionals.

What it means for your firm

Under Florida Statutes 558.004, the claimant generally serves the notice at least 60 days before filing suit. The person served may forward it to others within 10 days, has 30 days to inspect, and must serve a written response within 45 days. Association claims have longer periods.

Report a 558 notice to your insurers right away and before you respond. This is general information, not legal advice; confirm your deadlines with counsel.
