Notice of Circumstance

Telling your insurer about a situation that could lead to a claim before anyone has made a demand. On many claims-made policies, a proper notice can tie a later claim to the policy in force when you reported it.

What it means for your firm

Examples include a client complaint about your work, a problem found during construction, or someone mentioning attorneys. Each policy defines what a circumstance is and what the notice must include.

Reporting early does not admit fault. It gives the insurer a chance to help before the situation hardens. Whether and how a later claim attaches to the policy depends on the policy wording.
