Statute of Repose

A state law that sets an outside time limit for bringing certain claims, usually measured from completion of a project, regardless of when a problem is discovered.

What it means for your firm

For example, Florida generally requires actions founded on the design, planning or construction of an improvement to real property to be brought within 7 years of the certificate of occupancy or similar milestone, with some exceptions (Fla. Stat. 95.11(3)(b)). Other states use different periods.

Repose periods are one reason clients ask design firms to keep coverage in force for years after a project ends. This is general information, not legal advice.
