Grave Injury (NY)
A defined list of serious injuries in New York Workers' Compensation Law Section 11 that can allow a third party to seek contribution or indemnity from an injured worker's employer.
What it means for your firm
The statute's list includes death, permanent and total loss of use or amputation of an arm, leg, hand or foot, paraplegia or quadriplegia, total and permanent blindness or deafness, and certain other permanent injuries. Read the statute for the full list.
A written indemnity agreement made before an accident can also open the door to these claims, which is why indemnity clauses in New York contracts deserve a careful read.
