Choice of Counsel

Whether you or the insurer picks the defense lawyer on a claim. Many policies let the insurer choose, and some let you choose with the insurer's approval.

What it means for your firm

Most professional liability policies give the insurer the right to appoint defense counsel, usually from a panel of firms that regularly defend design professionals.

Some policies let you select a lawyer, often with the insurer's written approval and rules about experience and hourly rates.

If picking your own lawyer matters to you, ask about it before you buy and read that part of the policy.
